Council Member Paxson moved that for efficiency of the Pretrial Hearings, to authorize the Mayor Pro Tem to rule on motions and schedule dates, subject to objections of the City Council, seconded by Council Member Hernandez. The motion was approved with the following vote: Council Members Campos, Cantu, Hernandez, Paxson, and Vaughn voting "yes," and Council Member Scott voting "no." Legal Counsel for Mayor Guajardo John Flood and Legal Counsel for the Petitioners Doug Allison responded to Council questions. Mayor Pro Tem Vaughn entertained Mayor Guajardo's Verified Motion for Recusal and Disqualification. There were no additional recusals. Prior recusals were received from Council Members Barrera and Roy. Mayor Pro Tem Vaughn stated: "I hereby find that Rule 18 of the Texas Rules of Civil Procedure and Rule 605 of the Texas Rules of Evidence do not apply. Motion denied." The motion for recusal and disqualification was denied with the following vote: Council Members Campos, Cantu, Hernandez, Paxson, and Vaughn voting "yes," and Council Member Scott voting "no." Mayor Pro Tem Vaughn stated: "On Mayor Guajardo's Motion to Strike Pleading, I am going to limit arguments to 2 minutes per side. Legal Counsel Flood and Legal Counsel Allison presented their arguments. Based on the arguments presented, I move to deny the mayor’s motion to strike the pleadings.” Council Member Vaughn moved to deny the motion, seconded by Council Member Hernandez. The motion to strike pleading was denied with the following vote: Council Members Campos, Cantu, Hernandez, Paxson, and Vaughn voting "yes," and Council Member Scott voting "no." Mayor Pro Tem Vaughn entertained the Petitioners' First Amended Motion to Modify City's Rules of Procedure for City Council Hearing for Removal Action under the City Charter." Mayor Pro Tem Vaughn stated: “I hereby approve the requested changes to the Rules of Procedure except for proposed changes to Sections 1, 4.D., 6.D., and 7." Council Member Vaughn moved to approve the motion, seconded by Council Member Hernandez. The motion to modify was approved with the following vote: Council Members Campos, Cantu, Hernandez, Paxson, and Vaughn voting "yes," and Council Member Scott voting "no." Mayor Pro Tem Vaughn stated: “Both parties have filed witness lists and requested subpoenas. I move to authorize the attorneys for the petitioners and the mayor to issue subpoenas as requested in their motions. The requesting party will be responsible for service of subpoenas.” Council Member Vaughn moved to approve the motion, seconded by Council Member Hernandez. The motion was approved with the following vote: Council Members Campos, Cantu, Hernandez, Paxson, Scott, and Vaughn voting "yes." Mayor Pro Tem Vaughn asked: “For the scheduling of the Removal Action Hearing, have Petitioners' Counsel and Mayor’s Counsel agreed to some potential dates?” Petitioner's counsel and Mayor's counsel replied in the negative. Mayor Pro Tem Vaughn stated: "To address any additional pretrial matters, I hereby schedule June 8, 2026, and June 9, 2026 at 9:00 a.m., for pretrials. Meetings may be canceled if not needed. I also schedule the removal hearing for July 22, 2026 and July 23, 2026 at 9:00 am." Council Member Paxson moved to approve the motion, seconded by Council Member Hernandez.
