Confirm setback and condition details before building the metal carport
Applies if: You are the owner or builder of the 3034 Waldron Road carport
Why now: The 2026-09-23 record states a 5-foot RS-6 side setback in the staff report, 7 feet in Andrew Dimas's answer to Board Member Potter, and staff's finding that the structure must meet Building Code and Fire Code requirements.
What to do: Get the final approval letter or minutes and confirm the side setback (5 or 7 feet) and any conditions before ordering or siting the 1,840-square-foot carport. The approval was granted as presented by staff, which also requires Building Code and Fire Code compliance.
Act before: After the next material record update
Clarify carport approval discrepancies in Waldron Road exception
Applies if: You are reporting on the Board of Adjustment's approval of the carport exception
Why now: At the 2026-09-23 hearing, staff cited the 5-foot RS-6 side setback while Andrew Dimas confirmed 7 feet to Board Member Potter, and the motion by Board Member Lopez-Manzanares referenced 'the 2024 threshold' before passing with all aye votes; the item also appeared on 2026-08-26 and 2026-09-23.
What to do: Ask Development Services which setback applies and which approval threshold the motion used. The record is inconsistent, and the approved minutes should state the correct figures and any conditions.
Act before: After the requested records are produced

Andrew Dimas, Development Services, presented agenda item #2 to the Board: Appeal No. BA9390 Special Use Exception (SUE) to allow for an accessory building to exceed 50% of the total square footage of the main principal structure The purpose of this appeal is to request a Special Use Exception (SUE) to allow for an accessory building to exceed 50% of the total square footage of the main principal structure. The property is currently zoned “RS-6” Single-Family 6 District and is approximately 1.90 acres in size. The applicant also owns the property to the west, which is a lot of 1.41 acres. There is an existing single-family home on the property, and the owners propose to construct a new 1,840 square-foot detached metal carport to store outdoor equipment. The new carport will be located directly behind the existing home and will maintain the side yard setbacks per the “RS-6” zoning district which is 5 feet from the side property line. The adjacent neighbor is also zoned “RS-6” Single-Family 6 District. The City’s UDC states the following in regard to reviewing a Special Use Exception (SUE): 3.12.3. Review Criteria: In determining whether to approve, approve with conditions or disapprove a special use exception, the applicable review bodies shall consider the following areas: 1. The use conforms in all other respects to regulations and standards in this Unified Development Code. 2. The impact of the use on public infrastructure such as roads, natural gas, water, storm water and wastewater systems, and on public services such as police and fire protection and solid waste collection can be minimized without negatively impacting existing uses in the area and in the City. 3. If located within or adjacent to a residential area, the physical appearance, hours of operation and conduct of the use does not generate excessive noise, dust, smoke, glare and spillover lighting or other forms of environmental pollution or otherwise detrimentally affect the residential character of the area. 4. The use takes adequate measures to control or eliminate smoke, dust, glare, hazardous materials, noise or vibration caused by operations. Staff Analysis: After review, City staff has determined that the proposed special use exception does meet the required findings described in section 3.12.3 of the UDC. To summarize the required findings: 1. The proposed accessory structure will need to meet all Building Code and Fire Code requirements. 2. There are no negative impacts to public infrastructure. 3. There are no negative impacts to the surrounding properties. 4. There are no negative impacts to the environmental quality. The Board of Adjustment may impose reasonable conditions upon the granting of a special use exception consistent with the purposes stated in this Unified Development Code. Staff Recommendation: After evaluation of case materials provided and subsequent staff analysis including land development, surrounding uses and zoning, transportation and circulation, utilities, and considering public input, Staff recommends approval of the Special Use Exception (SUE). Board Member Potter asked if the garage was attached and Andrew Dimas stated no, it is detached. He also asked about the setbacks. Andrew Dimas confirmed it would be 7ft from the property line. Board Member Rios agrees with staff’s recommendation. She states this tract of land allows for the adjustment to be made, and the criteria has been met. With no other questions, Chairman Crowson opened for public comment. Karen Lighter appeared in favor of agenda item #2. No opposition. Being no other public comment, Chairman Crowson closed public comment. A motion was made by Board Member Lopez-Manzanares to approve the request for the 2024 threshold for agenda item #2 as presented by staff. Board Member Rios seconded. The Vote: All Aye. Motion passed.
