M&C 26-0631 recommends adopting an ordinance amending Chapter 29.5 'Smoking' of the City Code to update the definition of electronic smoking devices to include vaping, lower the retail smoke shop gross annual sales threshold from 90% to 51%, and expand the operating prohibition from 300 feet to 500 feet from schools, universities, hospitals, parks, places of worship, and daycare centers to align with the Zoning Ordinance.

Authorizes a $225,000 settlement and payment to Laurie Martinez and the Law Offices of Edward Sampson, PC, for full and final settlement of claims stemming from a September 2024 collision involving a Fort Worth police vehicle. Funding is budgeted in the Lawsuit Payments/Settlements account within the Risk Financing Fund.

Authorizes execution of an agreement with McGuireWoods Consulting LLC for state lobbying services for the City Attorney Department at up to $144,000.00 annually for an initial one-year term, plus four one-year renewal options at the same annual amount. The services were competitively procured through RFP 26-0164 after a 2025 state law change subjected lobbying services to public procurement.
